§ 47-302. Well operation permit.

  • The village may grant a permit to the private owner of a well existing on the effective date of the ordinance from which this article is derived to operate the well for a period not to exceed five years, provided the conditions of this subsection are met. An owner may request renewal of a well operation permit by submitting information verifying that the conditions of this section are met. The village or its designated agent may conduct inspections or have water quality tests conducted at the applicant's expense to obtain or verify information necessary for consideration of a permit application or renewal. Permit applications and renewals shall be made on forms provided by the village clerk. The following conditions must be met for issuance or renewal of a well operation permit:

    (1)

    The well and pump installation meet or are upgraded to meet the requirements of Wis. Admin. Code ch. NR 112, in effect on the date the application is submitted.

    (2)

    The well construction and pump installation have a history of producing bacteriologically safe water, as evidenced by at least two samplings taken a minimum of two weeks apart. No exception to this condition may be made for unsafe wells unless the department of natural resources approves, in writing, the continued use of the well.

    (3)

    There are no cross connections between the well and pump installation and the municipal water system.

    (4)

    The proposed use of the well and pump installation are reasonably necessary in addition to water provided by the municipal water system.

    (5)

    An application fee in the amount established by appendix A to this Code shall be paid to the village treasurer at the time the application is filed. In the event the application is denied, one-half of the amount of said fee will be refunded to the applicant.

    (6)

    A fee in the amount established by appendix A to this Code shall be paid on the fifth anniversary of the approval of said application in respect to the five year period commencing on such fifth anniversary, and an additional fee in the amount established by appendix A to this Code shall be paid at the commencement of each succeeding five year period while the permit remains in effect. The fees paid pursuant to this subsection shall be nonrefundable.
