Charter Ordinance Number 3

An ordinance providing the officers and the duties thereof of the Village of Clinton, Rock County, Wisconsin.

The Village Board of the Village of Clinton, Rock County, Wisconsin, does hereby ordain and establish:

SECTION 1. Village President; duties: The president shall be by virtue of his office a trustee and preside at all meetings of the board, and have a vote as trustee, sign all ordinances, rules, by-laws, regulations, commissions, licenses and permits adopted or authorized by the board, and all orders drawn on the treasury except as otherwise provided by Wisconsin Statutes. He shall maintain peace and good order, see that the ordinances are faithfully obeyed, and, in case of disturbance, riot or other apparent necessity, appoint as many special marshals as he shall deem necessary, who for the time being shall possess all the powers and rights of constables.

SECTION 2. Village Clerk. duties: The village clerk shall execute and file an official bond. It shall be his duty:

(1)

To perform any duties prescribed by law relative to elections, to keep subject to inspection all election returns required to be filed in his office, and to notify persons elected or appointed to village offices.

(2)

To transmit to the County Clerk, within ten days after election and qualification, a certified statement of the name and term for which elected, of the president, clerk, treasurer, supervisor and assessor; and to the Clerk of the Circuit Court immediately after their election or appointment and qualification, a like statement of the time and term for which elected or appointed of every Justice of the Peace, Marshall or Constable of the Village.

To attend all meetings of the village board; to record and sign the proceedings thereof and all ordinances, rules, by-laws, resolutions and regulations adopted, and to countersign and keep a record of all licenses, commissions and permits granted or authorized by them, and for such purpose to keep the following books: A minute book in which shall be recorded in chronological order all the papers mentioned in section 61.11 of the Wisconsin Statutes; full minutes of all elections, general or special, and the statements of the inspectors thereof; full minutes of all the proceedings of the board of trustees, the titles of all ordinances, rules, regulations and by-laws, with reference to the book and page where the same may be found. An ordinance book, in which shall be recorded at length, in chronological order, all ordinances, rules, regulations and by-laws. A finance book in which shall be kept a full and complete record of the finances of the village, showing the receipts, the date, amount and sources thereof, and the disbursements, with the date, amount and object for which paid out; and to enter in either such other matters as the board shall prescribe, and such other books as the board direct.

To countersign and cause to be published or posted every ordinance, by-law or resolution as required by law, and to have proper proof thereof made and filed.

(5)

To be the custodian of the corporate seal, and to file as required by law and to safely keep all records, books, papers or property belonging to, filed or deposited in his office, and deliver the same to his successor when qualified; to permit any person with proper care to examine and copy any of the same, and to make and certify a copy of any thereof when required, on payment of the same fees allowed town clerks therefor.

To draw and countersign all orders on the village treasury ordered by the board and none other.

(7)

To make a tax roll and deliver the same to the village treasurer; to make and transmit to the county clerk a statement showing the assessed valuation of all the property in the village and separately the amount of all taxes levied therein, including highway and street taxes, for the current year, and the purposes for which they were levied.

(8)

To perform all other duties required by law or by any ordinance or other direction of the village board.

SECTION 3. Village Treasurer; duties. The village treasurer shall execute and file an official bond which may be furnished by a surety company as provided by section 204.07 of the Wisconsin Statutes. It shall be his duty to receive all moneys belonging or accruing to the village from any source whatever or directed by law to be paid to him; to deposit upon receipt thereof the funds of the village in the name of the village in the public depository designated by the board, and failure to comply with the provisions hereof shall be prima facie grounds for removal from office, and when the money is so deposited, the treasurer and bonds-men shall not be liable for such losses as are defined by subsection (8) of section 34.01 of the Wisconsin Statutes, and the interest arising therefrom shall be paid into the village treasury; to pay the same only on the written order of the president, countersigned by the clerk and specifying the number thereof, the payee and the amount and object for which drawn; to keep just and accurate detailed accounts of all such transactions, showing when, to whom and for what purpose all payments are made, in books provided by the village board, and preserve all vouchers filed in his office; to render an account and settlement of all his official transactions to the board at its last meeting prior to the annual election, and at all other times when required by them; to deliver to his successor when qualified all books of account, papers and property of his office and all money in his hands as treasurer, and to perform such other duties as are required by law or the village board. There shall be kept but one fund in the treasury, except as otherwise provided. The treasurer shall also execute the bond required by section 70.67 of the Wisconsin Statutes and take receipt therefor, which he shall file in the office of village clerk. On receipt of the tax roll he shall, and while acting as collector of taxes, exercise the same powers and perform the same duties as are by law conferred upon and required of town treasurers while acting in that capacity, and be subject to the same penalties and liabilities.

Section 4. The office of the Village Treasurer may be combined with that of the Village Clerk at the pleasure of the Village Board by resolution duly passed and made a part of the minutes of the Village records. Such resolution shall provide that the duties of the Village Treasurer as herein prescribed and the duties of the Village Clerk as herein set forth shall be performed by the same person.

SECTION 5—Village Assessor duties: The village assessor shall after appointment, by the village board take and file the official oath. He shall make an assessment of all the property in the village liable to taxation in the manner prescribed by law and shall return the assessment roll to the village clerk at the time and manner provided for by statute.

SECTION 6. Village Marshall; duties: The village marshall shall execute and file an official bond. He shall possess the powers, enjoy the privileges and be subject to the liabilities conferred and imposed by law upon constables, and be taken as included in all writs and papers addressed to constables. It shall be his duty to obey all lawful written orders of the village board; to arrest with or without process and with reasonable diligence to take before the justice of the peace every person found in such village in a state of intoxication or engaged in any disturbance of the peace or violating any law of the state or ordinance of such village. He may command all persons present in such case to assist him therein, and if any person, being so commanded, shall refuse or neglect to render such assistance he shall forfeit not exceeding ten dollars.

SECTION 7: Village Engineer; duties: It shall be the duty of the village engineer to be present at all meetings of the village board, and he shall perform such duties as are prescribed by law or may hereafter be directed by the village board.

SECTION 8. Village Attorney: duties: It shall be the duty of the village attorney to be present at all meetings of the village board, and he shall perform such duties as are prescribed by law or may hereafter be directed by the village board.

SECTION 9. This is a charter ordinance, and shall take effect sixty days after its passage and publication, unless within such sixty days a referendum petition shall be filed as provided by Section 66.01 of the Wisconsin Statutes, in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.

Charter Ordinance Number 4

An ordinance providing for the personnel, fixing compensation, working hours and eligibility of officials and employees.

The Village Board of the Village of Clinton, Rock County, Wisconsin, does hereby ordain and establish:

Section 1. Pursuant to sections 61.195, 61.197 and 66.01 of the Wisconsin Statutes, the Village of Clinton hereby elects not to be governed by those portions of sections 61.19, 61.23, and sub-section (2) of section 61.25 of the statutes which relate to the selection and tenure of the assessor, clerk, constable and treasurer, and which are in conflict with this ordinance. After January 1, 1955, instead of being elected as provided in section 61.19 of the statutes, the assessor, clerk, marshal, and Treasurer of the Village of Clinton shall be appointed by vote of two thirds of the members-elect of the village board. The said assessor, clerk, marshal, and treasurer shall each hold office for indefinite term, subject to removal as provided by law. This ordinance shall not in any way affect the right of any person holding any of the aforementioned offices, either at the time of the passage of the ordinance or at the time it takes effect, to complete his term of office.

Section 2. The salaries, wages and other compensation paid by the Village of Clinton to the officials or employees thereof shall be determined by the village board. Adjustments in the compensation to be paid to the occupant of each position shall be made by the Village Board.

Section 3. All village officials or employees who have continued in the service of the village for one year shall be allowed one weeks vacation, and all village officials or employees who have continued in the service of the village for two years shall annually thereafter be allowed two weeks' vacation without deduction from their compensation. The time when said vacations are granted shall be in the discretion of the Village Board.

Section 4. This is a charter ordinance and shall take effect 60 days after its passage and publication, unless within such 60 days a referendum petition shall be filed as provided by section 66.01 of the Wisconsin statutes, in which event this ordinance shall not take effect until submitted to a referendum and approved by a majority of the electors voting thereon.

A CHARTER ORDINANCE REVISING PROCEDURES

FOR THE CALL OF SPECIAL MEETINGS OF THE VILLAGE BOARD.

THE VILLAGE BOARD OF THE VILLAGE OF CLINTON, ROCK COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS:

Section I. 2.02(2) of the Municipal Code is amended to read as follows:

2.02 MEETINGS.

(2)

SPECIAL MEETINGS. Special meetings of the village board may be called by any two trustees, including the village president, in writing, filed with the clerk. Such writing, containing the call for a special meeting, shall be filed with the clerk at least 24 hours prior to the commencement of such meeting; where it is impossible, or impractical to file such writing 24 hours prior to the commencement of a special meeting, such writing may be filed not less than two hours prior to the commencement of such special meeting and the presiding officer at such special meeting shall, immediately after such special meeting is called to order, publically announce the circumstances which made filing of such writing, less than 24 hours prior to the commencement of such special meeting, impossible or impractical. Upon the filing of such writing in the office of the clerk, the clerk shall immediately notify each trustee of the time, place and subject matter of such special meeting by causing a written notice thereof to be delivered to each trustee personally, if such trustee can be found, or if such trustee cannot be found, then by leaving a copy of such notice at the home of such trustee. In lieu of delivery of such written notice, the clerk may notify each trustee of the time, place and subject matter of such special meeting by direct telephone conversation with such trustee during which the clerk shall read verbatim to such trustee the entire contents of such written notice. The clerk shall, at the time of calling the roll at such special meeting, publically announce the means by which notice of such special meeting was given to each trustee not present, and shall record such public announcement in the minutes of such special meeting. Prior to the time of approval of the minutes of such special meeting, the clerk shall file in the office of the clerk an affidavit stating the name of each trustee, and either the fact that such trustee was present at such special meeting, or that notice of such special meeting was given to such trustee in the manner set forth in this subsection. The presence of a trustee at such special meeting shall constitute a waiver by such trustee of notice of such special meeting. Any trustee may file written consent to the holding of such special meeting, and thereby waive notice of the same, such written consent to be filed in the office of the clerk at anytime prior to the time at which the minutes of said special meeting are approved at a regular meeting of the village board. If, at any regular or special meeting of the village board, a subsequent special meeting is scheduled by means of an affirmative vote of the village board, every member of the village board present at the time such vote is taken shall be deemed to have received due and proper notice of such subsequent meeting, and shall be deemed to have waived any other notice thereof. Any special meeting for which notice of the same is given, or waived in accordance with this subsection shall be a regular meeting for the transaction of any business that may come before such meeting.

Section II. This ordinance shall take effect and be in full force from and after its passage and publication as provided by law.

ORDINANCE # 4

A CHARTER ORDINANCE REVISING THE MEMBERSHIP OF THE PARK

BOARD AND CONSOLIDATING THE STANDING COMMITTEES FOR

PUBLIC SAFETY AND PUBLIC WELFARE

THE VILLAGE BOARD OF THE VILLAGE OF CLINTON, ROCK COUNTY, WISCONSIN, DO DRAIN AS FOLLOWS:

Section I. 1.36 of the Municipal Code is amended to read as follows:

1.36 PARK BOARD.

(1)

HOW CONSTITUTED. The park board shall consist of two trustees and five citizens. The citizen members shall be persons of recognized experience and qualifications.

(2)

APPOINTMENT.

(a)

Trustee. One trustee member shall be appointed annually by the village president, subject to confirmation by the village Board, for a two-year term, commencing May 1.

(b)

Citizens. In even-numbered years, three citizen members shall be appointed by the village president, subject to confirmation by the village Board, each for a two-year term, commencing May 1. In odd-numbered years, two citizen members shall be appointed by the village president, subject to confirmation by the village Board, each for a two-year term, commencing May 1.

(3)

POWERS AND DUTIES. See §9.15 of this Code and §27.13, Wis. Stats.

Section II. The village board having determined that the duties and responsibilities of the standing committees on public safety and public welfare may be properly carried out by a single, consolidated committee, the standing committees on public safety and public welfare are hereby consolidated into a single standing committee to be known henceforth as the Public Safety and Welfare Committee. The consolidation of the two committees as required by this section shall be effective at the first regular meeting in May following the date on which this ordinance becomes effective.

Section III. 2.12(1) of the Municipal Code is amended to read as follows:

2.12 STANDING COMMITTEES. (1) APPOINTMENT. The following committees shall be appointed by the village president, subject to the approval of a majority of the board members at the first regular meeting in May of each year:

ORDINANCE #2006-10

AN ORDINANCE SEPARATING THE OFFICE OF VILLAGE CLERK FROM THE OFFICE OF VILLAGE TREASURER

THE VILLAGE BOARD OF THE VILLAGE OF CLINTON, ROCK COUNTY, WISCONSIN, DO ORDAIN AS FOLLOWS:

Section I: 1.16 of the Municipal Code is repealed and recreated to read as follows:

1.16 VILLAGE CLERK AND VILLAGE TREASURER.

(1)

SEPARATE OFFICES. On the effective date of this ordinance, the offices of Village Clerk and Village Treasurer, heretofore combined to constitute the office of Village Clerk-Treasurer, shall be separated and henceforward established as separate offices. The duties of the Village Clerk and the Village Treasurer may be assigned in the manner provided for below.

(2)

DUTIES OF VILLAGE CLERK.

(a)

Applicable Statute. See Section 61.25, Wis. Stats.

(b)

Other Duties Prescribed by Law. He/she shall perform such other duties as prescribed by State law or by order of the Board. He/she generally shall perform, under the direction of the President or other presiding officer of the Board, all duties pertaining to his/her office as Clerk, and shall be responsible for all the official acts of his/her assistants.

(3)

DUTIES OF VILLAGE TREASURER.

(a)

Applicable Statute. See Section 61.26, Wis. Stats.

(1)

Other Duties Prescribed by Law. He/she shall perform such other duties as shall be prescribed by State law and by order of the Board.

(4)

ASSIGNMENT OF DUTIES BY VILLAGE BOARD. The Village Board may, by resolution, from time to time, provide that the respective duties of the separate offices of Village clerk and Village Treasurer shall be performed by the same person.

Section II: This ordinance shall take effect sixty (60) days after its passage and publication, as provided by law.

A CHARTER ORDINANCE TO AMEND CHARTER ORDINANCE #4 (SECTIONS 2-84 AND 2-85) REVISING THE APPOINTMENT AND COMPOSITION OF STANDING COMMITTEES IN THE VILLAGE OF CLINTON

THE VILLAGE BOARD OF THE VILLAGE OF CLINTON, ROCK COUNTY, WISCONSIN, DOES ORDAIN AS FOLLOWS:

DIVISION 3. STANDING COMMITTEES

Sec. 2-84. Appointment.

The following committees shall be appointed by the village president, subject to the approval of a majority of the village board members at the organizational meeting each year:

Sec. 2-85. Composition of committees.

Each standing committee shall consist of five members, at least one of which is a trustee, appointed annually by the village president. The trustee is subject to confirmation by the village board, for a one-year term commencing May 1. In addition, each year, two citizen members shall be appointed by the village president, subject to confirmation by the village board, each for a two-year term commencing May 1. Non-trustee members shall be citizens of the Village of Clinton and be of recognized experience or qualifications. The chair of the committees shall be designated by the village president. Each member shall serve as appointed unless excused by a majority of the members of the village board.
